Terms of Service

Ellen’s Chinese Name Design - a service of 2WAYS COMPANY LIMITED

These Terms of Service apply when you purchase or use Ellen’s Chinese Name Design services through ChineseNameWise.com or directly with Ellen Yule / Yú Líng 余玲.

By placing an order, making payment, submitting an audit form, or using the service, you agree to these Terms.

 

  1. The Service

Ellen’s Chinese Name Design provides a personalised Chinese name design service for western professionals, business owners, consultants, hi-tech founders, authors, executives, speakers, founders, and other China-facing professionals.

The service is for personal Chinese names only.

It is not for business names, company names, brand names, product names, trademarks, official legal name registration, or government registration.

Depending on the package purchased, the service may include Chinese name design, simplified and traditional Chinese characters, pinyin, English explanation, name story, surname explanation, pronunciation guidance, writing guidance, usage guidance, commercial usage rights, and support materials listed on the relevant service page at the time of purchase.

The service is a creative, cultural, linguistic, and professional identity service. It is not legal advice, trademark advice, financial advice, business advice, immigration advice, or official registration advice.

 

  1. Packages and Pricing

The available packages, inclusions, and prices are listed on the service page at the time of purchase.

Prices are listed in USD and are exclusive of 15% GST where applicable, unless otherwise stated on the checkout page or invoice.

2WAYS Co.Ltd. may update packages, pricing, inclusions, bonuses, or service descriptions from time to time.

The package you receive will be based on the package description available at the time you purchase.

 

  1. Client Responsibilities

To complete your Chinese name design, you agree to provide accurate, thoughtful, and relevant information through the Chinese Name Audit Form and any other requested intake process.

You are responsible for providing information about your name, background, professional role, intended use, preferences, pronunciation concerns, cultural sensitivities, and any other details that may affect the name design.

The quality and suitability of the final name may be affected if you provide incomplete, inaccurate, unclear, or misleading information.

You are also responsible for reviewing the delivered name materials and deciding whether and how to use the Chinese name in your own professional context.

 

  1. Design Process and Delivery

After payment is completed, you will be asked to complete the Chinese Name Audit process.

The design process begins only after Ellen confirms that all required information has been received.

The 10-day delivery period starts from the date Ellen confirms that all required information has been received.

Ellen will aim to deliver your completed Chinese name package within 10 days from that confirmation date, unless otherwise agreed in writing.

Delivery may be delayed if:

  • you do not complete the audit form,
  • you provide incomplete information,
  • additional clarification is needed,
  • you request a change in scope,
  • you are slow to respond to reasonable questions,
  • technical issues occur outside Ellen’s control, or
  • unexpected personal, business, or operational circumstances arise.

If a delay occurs, Ellen will communicate with you as soon as reasonably possible.

 

  1. Nature of the Chinese Name Design

Ellen will design your Chinese name with care, cultural intelligence, professional judgement, and attention to meaning, pronunciation, written characters, cultural fit, personal identity, professional positioning, and practical use.

However, Chinese naming is partly subjective.

Different Chinese speakers may have different preferences, regional associations, dialect influences, generational views, aesthetic tastes, or cultural interpretations.

Ellen does not promise that every Chinese speaker will respond to the name in the same way.

Ellen does not promise that the name will be universally preferred in every Chinese-speaking market, region, industry, social group, or cultural context.

 

  1. No Guaranteed Business Results

A professionally designed Chinese name may help you make a stronger cultural impression, become easier to remember, and communicate respect in Chinese-speaking contexts.

However, Ellen and 2WAYS Co.Ltd. do not guarantee any specific business, financial, reputational, relationship, media, sales, partnership, investment, speaking, publishing, immigration, legal, or career outcome.

The service does not guarantee that you will win clients, close deals, receive media attention, gain followers, secure partnerships, increase revenue, or be accepted by any person, company, institution, market, or platform.

You acknowledge that your results depend on many factors outside Ellen’s control, including your business model, market, communication, relationships, reputation, timing, strategy, and how you use the name.

 

  1. What Is Not Included

Unless expressly included in your package or agreed in writing, the service does not include:

  • business naming,
  • company naming,
  • brand naming,
  • product naming,
  • domain name advice,
  • trademark searches,
  • trademark registration,
  • legal name registration,
  • government registration,
  • copywriting beyond the listed package materials,
  • translation of large documents,
  • Chinese market research,
  • business consulting,
  • public relations,
  • guaranteed media exposure,
  • guaranteed book or website features,
  • implementation work on third-party platforms,
  • or ongoing marketing support.

Any additional services must be quoted and agreed separately.

 

  1. One Revision Included

Your service includes one reasonable revision round after delivery.

This revision round is intended to refine the Chinese name package if there is a genuine issue with fit, clarity, pronunciation, meaning, professional positioning, or practical use.

The revision round may include reasonable adjustments to the name explanation, pronunciation guidance, usage guidance, or supporting materials.

It does not include unlimited redesigns, multiple alternative names, a completely new direction, a new brief, or additional materials outside the package you purchased.

Revision requests must be made in writing within 14 days of delivery.

If you do not request a revision within 14 days of delivery, the name package will be considered accepted.

Additional revisions, alternative name options, new directions, or extra supporting materials may incur an additional fee.

This does not limit any rights you may have under applicable New Zealand consumer protection laws.

 

  1. 90-Day Check-In and Support

Where your package includes 90-day check-in and support, this support is provided by both email and Zoom.

The purpose of this support is to help you understand, pronounce, explain, and use your Chinese name appropriately.

Support may include reasonable follow-up questions about name usage, pronunciation, written form, email signature usage, profile usage, WeChat usage, intro scripts, or practical application.

The 90-day support does not include unlimited consulting, marketing strategy, sales coaching, translation work, legal review, brand strategy, new naming work, or ongoing implementation services unless agreed separately.

Zoom support must be scheduled at a mutually suitable time.

 

  1. Commercial Usage Rights

After full payment has been received, you receive the right to use your completed Chinese name and the included name materials for your personal and professional use.

“Lifetime right for commercial use” means unrestricted ongoing use after full payment.

This may include use on business cards, email signatures, WeChat, LinkedIn, websites, public profiles, books, presentations, events, introductions, and other personal branding or professional contexts.

This right applies to your personal Chinese name as delivered to you.

It does not give you ownership of Ellen’s frameworks, templates, methods, explanations, reports, design process, teaching materials, package names, service names, website copy, or other intellectual property.

 

  1. Intellectual Property

Ellen and 2WAYS Co.Ltd. retain ownership of their methods, frameworks, processes, templates, educational materials, naming approach, package structure, service names, written explanations, and original supporting materials.

You may use your final Chinese name and the materials delivered to you for your own personal and professional purposes.

You may not copy, resell, reproduce, teach, publish, license, or commercially exploit Ellen’s design process, frameworks, templates, reports, or written materials as your own service or product without written permission.

 

  1. Client Approval and Use

You are responsible for deciding whether and how to use your Chinese name.

Before using the name in high-stakes legal, publishing, academic, official, trademark, immigration, government, corporate, or contractual contexts, you should seek relevant professional advice where appropriate.

Ellen and 2WAYS Co.Ltd. are not responsible for consequences that arise from your use, misuse, alteration, mistranscription, mispronunciation, unauthorised modification, or third-party interpretation of the name after delivery.

 

  1. Refunds and Cancellations

Because Chinese name design is a personalised creative service, the refund policy depends on the stage of work.

If you cancel in writing at least 7 days before work starts, you may receive a refund, minus online payment transaction fees and foreign currency exchange fees.

Work starts when Ellen begins reviewing your audit information, preparing your naming strategy, researching your context, or designing your Chinese name.

If you cancel after the audit form has been submitted but before Ellen has begun designing your Chinese name, you may receive a 50% refund. Once Ellen has begun reviewing, researching, or designing your Chinese name, no refund is available except where required by law.

After the Chinese name has been delivered, no refund is available simply because you change your mind, prefer a different style, or decide not to use the name. However, you may request the one included revision round described in Section 8.

No refund is available after the revision round has been completed, except where required by applicable law.

Refund requests and revision requests must be made in writing by email to ellen at chinesenamewise.com.

Nothing in these Terms limits any rights you may have under applicable New Zealand consumer protection laws.

 

  1. Payment

Payment is required before the service begins unless otherwise agreed in writing.

You agree to pay the price shown at checkout or in the invoice, including any applicable taxes, fees, GST, payment processing charges, or currency conversion costs.

If a payment fails, is reversed, disputed, or charged back, Ellen may pause or cancel the service until the payment issue is resolved.

 

  1. Confidentiality

Ellen will treat your personal information, audit form responses, professional background, naming preferences, and private communications with reasonable care and confidentiality.

Ellen may use your information for the purpose of providing the service, communicating with you, managing records, improving the service, and complying with legal or business obligations.

Ellen will not publicly share your Chinese name, testimonial, story, image, professional details, or identifying information without your permission, unless the information is already public or disclosure is required by law.

 

  1. Testimonials, Features, and Public Examples

Some packages may include a potential opportunity to be featured in Ellen’s book, website, case studies, marketing materials, or other public examples.

A potential feature opportunity is not a guarantee of publication, promotion, endorsement, sales exposure, media coverage, or public recognition.

Ellen will ask for your permission before using your name, image, testimonial, story, Chinese name, or identifying details for promotional or publication purposes.

 

  1. Accuracy and Cultural Interpretation

Ellen aims to provide accurate, thoughtful, and culturally informed name design and explanation.

However, language and culture are nuanced. Interpretations may vary across regions, dialects, generations, personal preferences, industries, and contexts.

You acknowledge that the service is based on Ellen’s professional judgement and the information available at the time of design.

The service does not guarantee one fixed or universal interpretation by every Chinese speaker.

 

  1. Limitation of Liability

To the extent permitted by law, Ellen and 2WAYS Co.Ltd. will not be liable for indirect, incidental, special, consequential, reputational, business, financial, or opportunity losses arising from your use of the service or your Chinese name.

To the extent permitted by law, Ellen’s and 2WAYS Co.Ltd.’s total liability in relation to the service is limited to the amount you paid for the relevant service.

Nothing in these Terms excludes, restricts, or modifies any rights that cannot be excluded under applicable New Zealand law.

 

  1. Third-Party Platforms

 You may choose to use your Chinese name on platforms such as WeChat, LinkedIn, Wikipedia, TikTok, email, websites, books, business cards, presentations, or public profiles.

Ellen and 2WAYS Co.Ltd. are not responsible for third-party platform rules, account restrictions, display limitations, technical issues, search results, audience reactions, or platform decisions.

 

  1. Changes to These Terms

2WAYS Co.Ltd. may update these Terms from time to time.

The Terms that apply to your purchase are the Terms in effect at the time you place your order, unless a later version is agreed in writing.

 

  1. Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute will first be handled through good-faith discussion.

If the dispute cannot be resolved informally, it will be handled under the applicable courts or dispute resolution processes of New Zealand, unless otherwise required by law.
